Terms of Service

By accessing or using TourTime at tourtime.app ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

TourTime is intended for licensed real estate professionals. By using the Service, you represent that you are a licensed real estate agent or broker, or are authorized to act on behalf of one.

TourTime is a mobile-first showing management platform that helps buyer's agents plan and run multi-home showing tours. Features include route optimization, showing scheduling, listing agent contact management, automated SMS messaging, and buyer-facing itinerary sharing.

You must create an account to use TourTime. You agree to provide accurate, current information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

Account sharing with other individuals is not permitted. Each agent on a team must have their own account or seat under a team plan.

TourTime offers a free trial period followed by a paid subscription. By providing payment information, you authorize us to charge the applicable subscription fee on a recurring basis.

Subscription fees are billed monthly or annually depending on your selected plan. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods.

We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

TourTime's automated texting feature sends SMS messages to listing agents on your behalf using phone numbers you provide. By using this feature, you agree to:

• Only send messages to listing agents in connection with legitimate showing requests for properties they represent
• Comply with all applicable laws and regulations governing commercial SMS messaging, including the TCPA
• Honor opt-out requests from recipients immediately
• Not use the messaging feature for marketing, spam, or any purpose other than showing coordination

Standard message and data rates may apply to recipients. TourTime is not responsible for carrier fees incurred by message recipients.

You agree not to use TourTime to:

• Violate any applicable law or regulation
• Send unsolicited commercial messages or spam
• Harass, threaten, or deceive other users or message recipients
• Attempt to gain unauthorized access to the Service or other accounts
• Reverse engineer, copy, or create derivative works of the Service
• Use the Service in any way that could damage, disable, or impair it

Your use of TourTime is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

You retain ownership of the data you enter into TourTime. By using the Service, you grant us a limited license to process and store your data solely to provide the Service to you.

You are responsible for ensuring you have the right to share any contact information or property data you enter into TourTime.

TourTime and its original content, features, and functionality are owned by TourTime and are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

TourTime is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.

Route optimization and drive time estimates are provided for convenience and may not reflect actual traffic conditions. You are responsible for verifying showing times and confirming appointments with listing agents.

To the fullest extent permitted by law, TourTime shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to missed showings, failed SMS delivery, or data loss.

Our total liability to you for any claim arising from use of TourTime shall not exceed the amount you paid us in the three months preceding the claim.

We reserve the right to suspend or terminate your account for violation of these Terms, non-payment, or for any other reason at our discretion with reasonable notice. You may terminate your account at any time through the account settings.

Upon termination, your right to use the Service ceases. We may retain certain data as required by law or for legitimate business purposes.

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the app. Continued use of TourTime after changes take effect constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of the State of Utah, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Utah.
